
Registration Application of Agents
1. Sivas Trade Registry Directorate has been registered and announced in the Trade Registry Directorate, the title must be a Real or Legal Entity in accordance with the legislation. (X INSURANCE AGENCY SERVICE.LTD.ŞTİ, X INSURANCE AGENCY SERVICE.LTD.ŞTİ or A.Ş etc.).
2. Turkey Union of Chambers and Commodity Exchanges of Chambers and Commodity Exchanges of the website of the Insurance Directorate of the first stage of the registration of the insurance agency application process must be made on-line.
3. After this process, the plate registration number will come to your e-mail account that you entered during the registration phase and you will be notified to apply to Sivas Chamber of Commerce and Industry.
4. Application should be made to the Insurance Transactions Unit of Sivas Chamber of Commerce and Industry with the requested documents.
5. Along with the application, the plate registration application fee and Minimum Physical Conditions Audit fees must be deposited to the cashier of our Chamber.
6. The Insurance Transactions Unit examines the documents you submit, and if the conditions are met, your application for registration is accepted. If missing documents are submitted, the documents will not be received. For this reason, our members are advised to be in contact with the staff of the Unit.
7. Immediately after your application is received, the staff of our Unit will visit your company to inspect the Minimum Physical Conditions and prepare a report. This inspection is carried out according to the criteria set by the Insurance Agents Executive Committee. If the report is not positive, your application for registration will not be accepted.
8. Upon approval of the company's application for registration, your application will be forwarded on-line to the Union of Chambers. No document review is made by TOBB Insurance Directorate. The examination made is whether the information in your TOBB-AEKS application (Company Partners, Technical Staff, Title, etc.) and the matters approved by our Unit meet the requirements for approval.
9. Conditions required for the agency manager appointed with limited authority by internal directive;
The insurance manager to be appointed with limited authority by internal directive must be “individually authorized for the works and transactions to be carried out in accordance with the insurance law numbered 5684”.
The approval of the agency manager who does not have individual authorization is not approved in accordance with Article 5/1 of the Circular No. 2016/27. In case of joint authorizations, the Director who is requested to be registered in the Register must be registered in the Register together with the other Director with whom he/she has joint signature authority.
10. Prohibition of other activities: The prohibition of other activities in the tenth paragraph of Article 23 of the Law is limited only to the commercial enterprise in which the agency activity is carried out. In this context, it is not possible to engage in any business other than insurance business and transactions and other intermediary activities related to insurance in the commercial enterprise where the agency activity will be carried out.
Other insurance-related intermediation activities are other intermediation transactions that may be an extension of the insurance contract and complement the preparation, implementation and termination of insurance contracts. Traffic follow-up operations, intermediation of invoice payments, etc. are not considered within the scope of other insurance-related intermediation activities
11. Your application approved by TOBB is sent on-line to the Undersecretariat of Treasury General Directorate of Insurance. The General Directorate review is conducted in the same way as the TOBB review.
12. The approval of the Undersecretariat of Treasury General Directorate of Insurance means that your company has received an insurance agency eligibility certificate. However, after this process, a registration fee is deposited into the TOBB's bank account.
13. With the registration of the deposited fee, your company will be seen in the province-based insurance agency search section of TOBB Insurance Directorate. 14. Your insurance agency will henceforth have the right to enter into an agency contract with an insurance company(s). However, if an agency contract with an insurance company is not established within six months following registration, it is a legal requirement to delete your registration.
15. Insurance Agents are obliged to notify the Unit in writing within 15 business days of any changes and innovations (shareholding structure, technical personnel, address, title, etc.) regarding their companies.
